HIPAA/FERPAThe HIPAA Privacy Rule was issued by the Federal Department of Health & Human Services (HHS) under the Health Insurance Portability and Accountability Act of 1996 (HIPAA). The Rule protects the privacy of individuals’ health information and medical records. The Family Educational Rights and Privacy Act (FERPA) of 1974 is a Federal law that protects the privacy of student education records. Both acts deal with student’s confidentiality and privacy rights. Both are additionally immersed with legal complexities that baffle most health care providers.
